THE INFORMATIVE TEXT ON PROCESSING PERSONAL DATA
AKL Law Office (“AKL”) gives importance to security of the personal data collected of “clients, business partners, employee candidates and other third parties” whom it is in contact with. AKL is assumed to be the Data Controller in regard to processing of below-mentioned personal data under “Turkish Personal Data Protection Act, No:6698” (“Act”). The further-mentioned activities are carried out in accordance with the necessities of the Act. According to article 3 of the Act, personal data means “any information relating to an identified or identifiable natural person”. Please do not share “information with personal data” which is more than necessary. For any activity of data processing based on “consent” hereunder stated, the consent is given via a clear, affirmative act/motion of yours (Data Subject) in the manner that sharing non-obligatory information with AKL via telephone, mails, e-mails and/or online platforms such as social media.
1)EMPLOYEE CADIDATES
The data such as “name, surname, nationality ID, gender, birth date and place, civil status, phone number, address, e-mail, photograph, diploma/degree, foreign language degree, previous work experience, computer knowledge, certificate and education information, course information, military service information” stated on CV’s and “interview notes” taken during the job interviews, that have been shared with AKL by yourself or by your references digitally or non-digitally (via sending mail or e-mails etc.), are collected by automated and non-automated means and such data are stored at archives, servers and e-mails of AKL. The personal data collected are processed based on the following legal grounds: “processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract” and “for the legitimate interests of the data controller without violating the fundamental rights of the data subject”; in the case that collected data involves sensitive data, the processing of such sensitive data is based on the employee candidate’s consent. The data is processed for the following purposes: “to carry out the job applicant’s recruitment process, to carry out candidate / trainee / students as traineeships / summer traineeships recruitment process, to carry out the HR process, to carry out communication activities, to carry out the business activities in regard to the law and legislation, to carry out the storing and archiving activities”. The collected personal data is not shared with third parties.
2)CLIENTS
In regard to providing legal services, the personal data such as “the data stated in national ID card, communication information, tax number, requests, information related to lawsuits and files at judicial and administrative authorities, information related to assets” that have been shared digitally or non-digitally with AKL by yourself is collected by automated and non-automated means and such data are stored at archives and e-mails of AKL. The personal data collected are processed based on the following legal grounds: “processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract”, “processing is necessary for the institution, usage, or protection of a right”, “it is expressly permitted by law”, “for the legitimate interests of the data controller without violating the fundamental rights of the data subject”; in the case that collected data involves sensitive data, the processing of such sensitive data is based on the client’s consent. The data is processed for the following purposes: “to carry out the business activities in regard to the law and legislation, to carry out the legal, litigation and counselling services, to carry out communication activities, to carry out / audit the business activities, to carry out the storing and archiving activities, to inform the authorized administrative bodies and public institutions”. The collected personal data is shared with “judicial authorities, governmental institutions and third parties that AKL works with” where necessary.
3)COMMUNICATION ACTIVITIES
Communicating with AKL whitout being a Client or an Employee
Candidate, the information and data such as “name, surname, the context of the message
and the communication information” that is shared digitally or non-digitally (via
mails and/or e-mail, etc.) with AKL is collected by automated and non-automated
means and such data are stored at archives, servers and e-mails of AKL. In case
the data subject is a Client Candidate, the personal data collected are
processed based on the following legal grounds: “processing is necessary for
the performance of a contract to which the data subject is party or in order to
take steps at the request of the data subject prior to entering into a
contract” and “for the legitimate interests of the data controller without
violating the fundamental rights of the data subject”; in the case that
collected data involves sensitive data, the processing for such sensitive data is
based on the data subject’s consent. Communicating with AKL whitout being a
Client, a Client Candidate or an Employee Candidate, the personal data collected
are processed based on the data subject’s consent. The data is processed for the
following purposes: “to carry out the business activities in regard to the law
and legislation, to carry out the legal, litigation and counselling services,
to carry out communication activities, to carry out / audit the business
activities, to carry out the storing and archiving activities”. The collected
personal data is not shared with third parties unless it is necessary.
The personal data may also be stored in the servers of the archiving service provider, hosting service provider and e-mail service provider that AKL works with. In case the communication takes place via social media, the personal data contained in the message may be stored in the servers of the social media company. The mentioned servers may be located in foreign countries. Therefor, in case sharing information with AKL, it is accepted that the Data Subject has knowledge on the probability for the location of the said servers and approves it.
As the Data Subject, you may apply to AKL in order to exercise the rights stating at the article 11 of the Act. In this context, in order to use your rights, please lodge your applications of exercising rights via sending a signed copy of the demand to the address of AKL: “Cumhuriyet Mahallesi, Arpa Suyu Sokak No:16/4 Şişli İstanbul” in person or through a notary, deliver it to alican.altinordu@hs01.kep.tr via using secured electronic signature/mobile signature or alialtinordu@akl-law.com e-mail address via using your e-mail which has been already registered at the AKL system.
